Before we file for you, we confirm your states. This table is a public reference and it only moves as fast as the phone calls. For a customer it works the other way round: every state you operate in gets confirmed with that state’s commission before any work starts — the portal, the fee, who is permitted to certify, and whether the LEPC and fire department copies are satisfied by the state filing or have to be sent separately. That includes states not listed here. You get what we found, in writing, before we begin.
Deadline. EPCRA 312 requires the Tier II report for the prior calendar year to be submitted by March 1. A state may set an earlier date or require additional reporting.
Certification. 40 CFR 370 requires certification by the owner or operator, or the officially designated representative of the owner or operator. Several states narrow this to an employee or corporate officer of the facility.
Penalties. EPCRA 325 civil penalties apply to non-filing and are adjusted annually for inflation. State penalties may apply on top.
Three recipients, not one. A Tier II report goes to three places: the SERC, the LEPC for the district, and the fire department with jurisdiction over the facility. The state portal does not always satisfy all three.
