Deadline. EPCRA 312 requires the Tier II report for the prior calendar year to be submitted by March 1. A state may set an earlier date or require additional reporting.
Certification. 40 CFR 370 requires certification by the owner or operator, or the officially designated representative of the owner or operator. Several states narrow this to an employee or corporate officer of the facility.
Penalties. EPCRA 325 civil penalties apply to non-filing and are adjusted annually for inflation. State penalties may apply on top.
Three recipients, not one. A Tier II report goes to three places: the SERC, the LEPC for the district, and the fire department with jurisdiction over the facility. The state portal does not always satisfy all three.
